DStewartGames Terms of Service

By downloading or using any mobile application (the "Apps") developed by Darien Stewart ("Developer," "we," "us," or "our"), operating under the name DStewartGames, you agree to comply with and be bound by the following terms and conditions.

These Terms apply to all current and future Apps unless otherwise stated.

1. License and Use of the Apps

  • Darien Stewart grants you a non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes.
  • You agree not to distribute, modify, reproduce, reverse engineer, or exploit the Apps for any commercial purpose without prior written consent from Darien Stewart.

4. Third-Party Services

  • The Apps may integrate third-party services such as Google AdMob, Unity Ads, and Unity Analytics.
  • Your use of these services is subject to their respective terms and privacy policies, and you agree to comply with them.

5. In-App Purchases

  • Some Apps may offer in-app purchases through platform providers such as Apple App Store or Google Play.
  • All purchases are processed by the respective platform provider and are subject to their terms and refund policies.
  • We do not have control over or responsibility for payment processing or refunds.

6. Disclaimer of Warranties

  • The Apps are provided "as is" and "as available" without any warranties, express or implied.
  • Darien Stewart does not guarantee that the Apps will be error-free, uninterrupted, or meet your expectations.

7. Limitation of Liability

  • Darien Stewart shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Apps.
  • In no event shall Darien Stewart's total liability exceed the amount paid by you, if any, for the Apps.

8. Changes to Terms

  • Darien Stewart reserves the right to update or modify these Terms at any time.
  • Users are encouraged to review the Terms periodically for changes. Continued use of the Apps after changes constitutes acceptance of those changes.

9. Termination

  • We reserve the right to suspend or terminate access to the Apps at our discretion, without prior notice, for conduct that violates these Terms.

10. Governing Law

  • These Terms are governed by and construed in accordance with the laws of the State of New York, United States.
